§ 102-56. Issuance; factors affecting determination.

  • (a)

    The board of commissioners shall determine whether the public convenience and necessity require the operation of the taxicab for which application for a certificate has been filed, and in making this determination, it shall consider the:

    (1)

    Adequacy of existing taxicab service and other forms of transportation for passengers already in existence.

    (2)

    Probable permanence and quality of the services to be offered by the applicant.

    (3)

    Financial ability, character, and responsibility of the applicant.

    (4)

    Number and character of vehicles, and the character and location of the depots and terminals proposed to be used.

    (5)

    Experience of the applicant in the transportation of passengers for hire in automobiles.

    (6)

    Truthfulness of the information furnished by the applicant in his application.

    (b)

    Should the board be satisfied that the public convenience and necessity require the operation of the taxicab for which an application has been filed, it may nevertheless refuse to grant the certificate to the applicant for any of the reasons for which a driver's permit may be refused.

    (c)

    The board shall have authority to grant a certificate as applied for or to grant a certificate to the applicant for a partial exercise of the rights, in exercise of sound discretion after a consideration of the factors above prescribed.
