§ 78-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning:

    Commercial means a private sector establishment such as retail businesses, offices, theaters, restaurants, warehouses, and other non-manufacturing activities.

    Construction and demolition debris means any waste building materials, packaging, and rubble resulting from construction, remodeling, repair, and demolition operations on pavements, houses, commercial buildings, walkways, driveways, signs, and other structures, including, but not limited to, excavated earth, trees and stumps, rocks, gravel, bricks, plaster, concrete, lumber, shingles, or other similar materials.

    Curb means a location within five feet from the edge of the street or road and suitable for collection of solid waste.

    Disposal container means any town issued roll-out garbage cart or other town approved container to include watertight dumpsters.

    Garbage means all putrescible wastes, including animal and vegetable matter, animal offal and carcasses, and recognizable industrial by-products, but excluding sewage and human wastes, capable of being decomposed by microorganisms with sufficient rapidity as to cause nuisance from odors and gasses. Putrescible wastes in general are daily household waste products.

    Hazardous waste means any waste which is a toxic substance or hazardous waste as defined in the Resource Conservation and Recovery Act, as amended, and related federal, state, and county laws and regulations including, but not limited to, pathological, medical, biological, human wastes, cleaning fluids, oils, paints, acids, caustics, poisons, explosive devices, sharps and drugs.

    Medical waste means any solid waste which is generated in the diagnosis, treatment, or immunization of human beings or animals, in research pertaining thereto, or in the production or testing of biological materials.

    Nonresidential means property or premises classified in the tax records of the county with a tax parcel identification number (PIN) including, but not limited to, group development parcels, apartments, condominiums and mobile home parks, and having eight or more family units on or within such property or premises.

    Refuse means all non-putrescible wastes.

    Residential means any property or premises classified in the tax records of the county as residential and having a single tax parcel identification number (PIN), including, but not limited to, single-family residential lots, group development parcels, apartments, condominiums and mobile home parks, and having less than eight single-family units on or within such property or premises.

    Sharps means any hypodermic needles, knives or instruments generally associated with medical practices or in-home treatments which cause a puncture, cut, or tear human or animal tissue.

    Solid waste means garbage, refuse, and other discarded solid materials, including semisolid waste materials resulting from homes, businesses, industrial, commercial, and agricultural operations, and from community activities, but does not include solids or dissolved materials in domestic sewage or other significant pollutants in water resources, such as silt, dissolved or suspended solids in industrial wastewater effluents, dissolved materials in irrigation return flows, or other common water pollutants.

    White goods means inoperative and discarded refrigerators, ranges, water heaters, freezers, and other similar domestic and commercial large appliances (i.e., washers, dryers, dishwashers, kitchen compactors, air conditioners, etc.).

    Yard waste means tree limbs less than six feet in length and/or six inches in diameter, leaves, shrubbery, trimmings, cuttings, and all other trimmings from the natural growth of trees, shrubbery, weeds, plants, or grasses.
