§ 58-108. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Alarm means any electronic or mechanical device which emits any signal, whether electronic, audible, silent or recorded, and which is designed, intended or used for the detection of an unauthorized intrusion or an attempted intrusion into a building, structure or premises or to signal an actual or attempted robbery. The term "alarm" shall include any device which initiates a telephone call and delivers a recorded message to any emergency telephone number assigned to or used by the communications center of the town. Any procedure by which a third party telephones any emergency telephone number and requests service on the basis of having received an automatic alarm signal from a subscriber or such person or alarm business represented by such person; or an audible signal or siren that when sounded is detected by a third party that results in a police response.

    False alarm means any alarm signal communicated by any means that solicits a police response and to which the responding officer finds no evidence of unauthorized intrusion, attempted intrusion, robbery or attempted robbery. False alarms also include negligently activated signals; signals as a result of faulty or improperly installed equipment in computing the number of false alarm responses, a false alarm shall not include an alarm which is determined to have been activated by adverse weather conditions or a failure in electrical power to the alarm that is not caused by the subscriber, nor shall it include an alarm activated during a testing procedure, provided that the subscriber or appropriate designee first notifies the town police department prior to the test. Test alarms without prior notification shall be considered false alarms.

    Subscriber means any person, firm, corporation or business owning or leasing an alarm system or on whose premises an alarm system is maintained.
