§ 34-114. Purpose and intent of article.

  • The state general assembly has concluded that secondhand smoke has been proven to cause cancer, heart disease, and asthma attacks in both smokers and nonsmokers and, in 2006, a report issued by the United States Surgeon General stated that the scientific evidence indicates that there is no risk-free level of exposure to secondhand smoke. Further, the Surgeon General of the United States has concluded that involuntary or passive smoking is the cause of disease, including lung cancer, in healthy nonsmokers and has estimated that involuntary smoking causes more deaths, approximately 5,000 per year, then all other airborne pollutants combined, excluding asbestos. The board of commissioners recognizes the increasing evidence that smoke creates a danger to the health of some citizens and is a cause of annoyance and physical discomfort to those who are near smoke. The purpose and intent of this article is to promote the public health, safety and general welfare by prohibiting smoking within all town property.
